The hierarchy of events in STS operations is significant when one seeks to define or allocate the liabilities over the actions of stakeholders involved. Although it is clear through IMO regulations that the assessment and responsibility for safety is an obligation of the master of each vessel, the yardstick set by the STS organizers through the C/P related clauses, the clearance requests and the industry guidelines complicate the ability of the master to assume responsibility for his duties prior to or during the STS operation. Are the current industry stakeholder contractual relations, the applicable legislation, and commercial regime mature enough to allow shipowners to safeguard the safety, as they ought to, or instead, has the developed industry infrastructure complicated the STS operations with potential impact to the safety and the exposure to litigation or claims?
