Clyde & Co in co-operation with DYNAMARINe organized the presentation entitled ? LIABILITIES RESPONSIBILITIES & REPUTATION? on Ship-to-Ship transfers on Wednesday 7th May at the Clyde & Co auditorium in their London office.


DYNAMARINe emphasized the Liabilities for Tanker Operators, Cargo owners and Service Providers and underlined the necessity of establishing Due Diligence actions that can ensure safety in a practical and justified way and strengthen the reputation of participating parties. Furthermore, DYNAMARINe outlined the concept of onlineSTS.net and its? benefits.

CLYDE &CO addressed the legal issues on based on charter party STS and other rider clauses associated with the appointment of the Service Provider and POAC. The court award on the Falconera ? Arcadia [2012] EWHC 3678 was presented; a leading case which found the ship owners were 'unreasonable' by withholding their approval of an STS request by their charterers for an operation between two VLCC vessels. The importance of 'due diligence' practices from STS stakeholders with respect to the POAC, service providers and nominated vessels by charterers was also emphasized.

DYNAMARINe and CLYDE & Co are preparing a guide entitled ?FREQUENT ASKED QUESTIONS ON Ship-to-Ship?. The final guide will include about 100 questions on STS. During the event a draft version of the guide was distributed to the participants which included 26 questions and answers. The draft guide is available for download in this web link.
